Terms of Service

These Terms of Service ("Terms") govern your access to and use of BengkelDay ("the Service", "the Platform"), a workshop management software-as-a-service platform operated for automotive workshops in Malaysia. By accessing or using the Service, you agree to be bound by these Terms.

1. Definitions

• "Service" refers to the BengkelDay web application and all related services
• "User" or "you" refers to any individual or business entity accessing the Service
• "Organisation" refers to a registered workshop or business entity on the Platform
• "Subscription" refers to your chosen pricing plan (FREE, PRO, or ENTERPRISE)
• "Content" refers to data, text, and information you enter into the Service

2. Eligibility

To use the Service, you must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately at support@bengkelday.com.my of any unauthorised access to your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription Plans and Payment

4.1 Plans

BengkelDay offers the following subscription tiers:

• FREE: RM 0/month — basic features with usage limits
• PRO: RM 199/month — expanded features for growing workshops
• ENTERPRISE: RM 499/month — unlimited features for large operations

All prices are in Malaysian Ringgit (MYR) and are inclusive of any applicable taxes. Feature limits and inclusions for each plan are detailed on our Pricing page.

4.2 Free Trial

New accounts receive a 14-day free trial of PRO features. No credit card is required for the trial. Upon trial expiry, your account will automatically downgrade to the FREE plan unless you subscribe to a paid plan.

4.3 Payment Processing

All payments are processed securely through Billplz, a licensed payment gateway in Malaysia. We do not store your payment card details on our servers. By subscribing to a paid plan, you authorise recurring monthly charges through your selected payment method.

4.4 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly) at the then-current price. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then.

4.5 Refund Policy

Subscription fees are non-refundable except where required by law. If you experience a technical issue that prevents you from using the Service, please contact us within 7 days for resolution.

5. Acceptable Use

You agree not to:

• Use the Service for any purpose that violates Malaysian law or applicable regulations
• Attempt to gain unauthorised access to the Service, other accounts, or our systems
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or harmful content
• Use the Service to transmit spam, phishing, or fraudulent communications
• Reverse engineer, decompile, or disassemble the Service
• Sublicense, resell, or redistribute access to the Service without our written consent
• Use the Service in any way that could damage our reputation or that of our users

6. Your Content and Data

6.1 Ownership

You retain full ownership of all Content you enter into the Service, including customer records, vehicle data, job cards, invoices, and any other business data. We do not claim any ownership rights over your Content.

6.2 Licence to Operate

By using the Service, you grant us a limited, non-exclusive licence to process, store, and display your Content solely for the purpose of providing and improving the Service. This licence terminates when your account is closed and your data is deleted.

6.3 Data Portability

You may request an export of your data at any time by contacting us. Upon account termination, we will make your data available for export for a period of 90 days before permanent deletion, in a structured, machine-readable format.

6.4 Data Privacy

Your data privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your data in compliance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.

7. Intellectual Property

The Service, including its design, code, features, logos, trademarks, and documentation, is the intellectual property of BengkelDay and is protected by Malaysian and international intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or branding without our prior written consent.

8. Service Availability

• We aim to maintain 99.9% uptime but do not guarantee uninterrupted availability
• We may perform scheduled maintenance with reasonable advance notice
• We are not liable for downtime caused by factors beyond our reasonable control
• We reserve the right to modify, suspend, or discontinue features with reasonable notice

9. Limitation of Liability

To the maximum extent permitted by Malaysian law:

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total aggregate liability to you for any claims arising from these Terms or the Service shall not exceed the total fees paid by you in the 12 months preceding the claim
• We are not liable for any loss of data, revenue, or business opportunities resulting from your use of the Service

10. Indemnification

You agree to indemnify, defend, and hold harmless BengkelDay and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Consumer Complaints

If you have a complaint regarding the Service, please contact us at support@bengkelday.com.my with the subject line "Service Complaint". We will acknowledge your complaint within 3 business days and aim to resolve it within 14 business days. If you are not satisfied with our resolution, you may escalate the matter to the Tribunal for Consumer Claims Malaysia or the relevant regulatory authority.

12. Termination

• By you: You may cancel your subscription and close your account at any time through your account settings or by contacting us
• By us: We may suspend or terminate your access if you violate these Terms, fail to pay subscription fees, or engage in activities harmful to the Service or other users
• Effect of termination: Upon termination, your right to use the Service ceases immediately. Your data will be retained for 90 days to allow for export, after which it will be permanently deleted (except where retention is required by law)

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or power outages, cyberattacks, pandemics, or any other force majeure event.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you may cancel your subscription before the effective date.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BengkelDay regarding your use of the Service, and supersede any prior agreements or understandings.
